Terms of Service

1. About DivideUte

This website is operated by WHENT PTY LTD trading as DivideUte, ABN 49 681 170 749. Throughout these Terms of Service, “DivideUte”, “we”, “us” and “our” refer to that business.

These terms apply to your use of divideute.com.au and purchases made through our online store. Our store is powered by Shopify.

Please read these terms alongside our Privacy Policy, Shipping Policy, Refund Policy and Warranty information, available on our website.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy available under the Australian Consumer Law or any other law that cannot lawfully be excluded. This applies to every section below, including provisions concerning Shopify and other service providers.

2. Using Our Website

You may use our website to browse and purchase products for personal or business use.

When placing an order, you must be at least 18 years old or have permission from a parent or guardian. If ordering on behalf of a business, you must have authority to do so.

You agree to provide accurate and current contact, billing, delivery and payment information. You must be authorised to use the payment method provided.

If you create an account, please keep your login details secure and notify us promptly if you suspect unauthorised access.

You must not use our website for unlawful purposes, submit fraudulent orders, introduce malicious software, interfere with website security or misuse another person’s information.

3. Product Information and Fitment

We aim to provide accurate product descriptions, photographs, dimensions and fitment information.

Colours and finishes may appear different depending on your screen settings. Photographs may show optional accessories or example installations. Refer to the product description for what is included in your purchase.

Before ordering, check the product dimensions, installation requirements and suitability for your vehicle, tray or tub. Liners, accessories and vehicle modifications may affect fitment.

If you are unsure, contact us at sales@divideute.com.au before purchasing. Please provide accurate vehicle details and any measurements or photographs we request.

Your responsibility to check fitment does not remove our responsibility for accurate descriptions or advice, or your rights where a product does not match its description or an agreed purpose.

We may update our product range and descriptions. Changes will not alter the specifications of an accepted order without your agreement.

4. Installation and Safe Use

Install and use products in accordance with the instructions provided for the relevant product.

Before drilling or fixing components, check the mounting location for wiring, fuel lines and other components that could be damaged. If you are unsure about installation, seek assistance from a suitably qualified installer.

Check brackets, fasteners and other components regularly. Stop using a product if it is damaged, loose or otherwise unsafe.

Do not assume a divider alone secures every type of load. Use suitable additional restraints where required, and comply with applicable load-restraint requirements and your vehicle’s limits.

Do not exceed any stated product capacity or use a product for a purpose outside its stated intended use.

These requirements do not limit your rights where a product is defective or our instructions are inadequate.

5. Orders and Acceptance

Placing an order is an offer to purchase the selected products. An automated order acknowledgement confirms receipt of your order; acceptance occurs when we confirm dispatch or expressly confirm acceptance separately.

We may decline an order for a reasonable reason, such as unavailable stock, an inability to deliver to the nominated address, payment failure or suspected fraud.

If a material pricing or description error affects your order, we will contact you before proceeding. We will not charge a higher price or substitute a materially different product without your agreement.

If we cannot fulfil an order, we will notify you and refund any payment for the unfulfilled items, including associated delivery charges where applicable.

Please check your order carefully before submitting it. Contact us promptly if you need to request a change or cancellation. Our ability to accommodate a change-of-mind request may depend on whether dispatch or custom work has begun. Your statutory rights remain unaffected.

6. Prices and Payment

Prices are displayed in Australian dollars and include GST where applicable.

Delivery charges and any selected optional extras are shown before you complete your purchase.

Prices and promotions may change, but changes will not affect an accepted order.

Payment must be received before an order is dispatched unless we have agreed otherwise in writing.

Any additional conditions for a promotion will be disclosed with the offer. Promotional conditions do not restrict your rights under Australian Consumer Law.

7. Shipping and Delivery

We dispatch orders from Rockhampton, Queensland. Dispatch timeframes, delivery estimates and shipping charges are explained in our Shipping Policy and any relevant product information.

Powder coating, custom work and other selected options may require additional preparation time.

Delivery estimates are not guaranteed arrival dates unless we expressly agree otherwise. If we become aware of a significant delay, we will contact you.

Please provide an accurate delivery address and any necessary delivery instructions. If an incorrect address or missed delivery results in additional delivery costs, we will explain those costs before arranging redelivery.

If your order arrives damaged, is missing items or has not arrived within the expected timeframe, contact sales@divideute.com.au. Please provide your order number and any photographs or other information that may help us investigate.

Where we arrange delivery, we will work with the delivery provider to resolve problems. We do not treat handing your order to a carrier as removing our obligations to you.

Nothing in this section limits your legal rights concerning non-delivery, unreasonable delays or damaged goods.

8. Returns, Refunds and Warranty

Our Refund Policy explains our change-of-mind return arrangements and any advertised money-back guarantee. Our Warranty information explains any additional product warranty we offer.

These policies and warranties operate in addition to your rights under Australian Consumer Law.

Where consumer guarantees apply, you may be entitled to a repair, replacement, refund or compensation, depending on the circumstances. You do not need to rely solely on an additional product warranty.

The expiry of an express warranty does not automatically end your statutory rights. Sale items and customised products also remain subject to applicable consumer guarantees.

For a return or warranty enquiry, contact sales@divideute.com.au with proof of purchase and a description of the issue. Photographs may help us assess the problem.

Please contact us before sending a product back so we can provide the appropriate return instructions. Return costs will be handled in accordance with your statutory rights and the applicable policy.

9. Relationship With Shopify

DivideUte is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with DivideUte. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and DivideUte, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with DivideUte.

This section is subject to the non-excludable rights described in section 1.

10. Privacy

We handle personal information in accordance with our Privacy Policy.

Our store uses Shopify and other service providers to support functions such as payment processing, order fulfilment and delivery. Personal information may be processed outside Australia, as explained in our Privacy Policy and the relevant providers’ privacy information.

11. Website Content and Intellectual Property

Website content, including our original photographs, text, graphics, logos and videos, is owned by DivideUte or used with permission.

You may view and save information reasonably needed to consider a purchase, install or use a product, or keep a record of your transaction.

You must not reproduce or use our content commercially without permission, except where permitted by law.

References to vehicle manufacturers, models or third-party brands are used for identification or fitment information. They do not imply an affiliation or endorsement unless expressly stated.

12. Reviews and Customer Content

Reviews and other content you submit must reflect your genuine experience and must not be misleading, unlawful or infringe another person’s rights.

When you submit a review for publication, you give us permission to display it on our website and in related product marketing. We may make minor formatting or spelling corrections without changing its meaning.

We will seek your permission before using privately supplied customer photographs or videos in marketing, unless you have already clearly authorised that use.

We may remove spam, abusive content, personal information or content that infringes another person’s rights. We will not remove a genuine review solely because it is negative.

13. Third-Party Websites and Tools

Our website may include third-party links, applications or tools. Those providers may have their own terms and privacy policies.

We do not control independently operated third-party websites or their content. Please review their terms before using their services.

This section does not remove our responsibility for our own representations, actions or obligations to you.

14. Website Availability and Liability

We take reasonable care in operating our website, but access may occasionally be interrupted for maintenance, technical problems or circumstances outside our reasonable control.

We do not exclude responsibility for failing to meet a consumer guarantee or for any other liability that cannot lawfully be excluded.

Subject to those protections, we are not responsible for loss to the extent it is caused by your unlawful conduct or your failure to follow reasonable installation and use instructions, rather than by a defect in our products, our negligence or our breach of an obligation.

Nothing in these terms makes you responsible for loss caused by our own conduct.

15. Suspension of Access

We may restrict or suspend access to our website or an account where reasonably necessary to address fraud, security threats, unlawful activity or a serious breach of these terms.

Where practicable, we will explain the reason and provide an opportunity to resolve the issue.

Suspension does not remove your rights relating to existing orders, refunds, warranties or consumer guarantees.

16. Changes to These Terms

We may update these terms from time to time. The current version will be published on this page.

Updated terms apply to future use of the website and future orders. They will not retrospectively reduce your rights under an existing order.

17. General Provisions

If a provision is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

A delay in exercising a right does not mean that right has been waived.

These terms and the policies relevant to your purchase form the agreement for that purchase, together with any specific arrangements we confirm in writing. They do not exclude any representation or obligation that cannot lawfully be excluded.

These terms are governed by the laws of Queensland and applicable Commonwealth laws of Australia. This does not limit any right you have to bring a claim in another court or tribunal with jurisdiction.
